1. Acceptance of Terms

By accessing or using VidGen ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service. These Terms constitute a legally binding agreement between you and VidGen.

2. Description of Service

VidGen is an AI-powered video generation platform that allows users to create videos from text prompts. The Service operates on a point-based system where 1 point ≈ 1 minute of video. Points are purchased in advance and consumed when video generation jobs are processed.

3. User Accounts & Points

You must sign in with a valid Google account to use VidGen. New accounts receive 3 free points as a welcome bonus. You are responsible for all activity and purchases made under your account. Points purchased are linked to your account and cannot be transferred.

4. Acceptable Use

You agree not to use VidGen to generate content that is illegal, harmful, defamatory, obscene, or harassing; that infringes the intellectual property rights of others; that depicts real individuals in a false, defamatory, or misleading manner without consent; that could be used for disinformation, political propaganda, or coordinated inauthentic behaviour; or for spam, mass-generation abuse, or any activity that degrades service quality for other users. We reserve the right to immediately terminate accounts that violate these terms without refund.

5. Content Ownership

You retain full ownership of the videos you generate using VidGen. By using the Service, you grant VidGen a limited, non-exclusive licence to store, process, and deliver your generated content solely to provide the Service. VidGen does not claim any rights over your generated output.

6. AI-Generated Content Disclaimer

All videos, scripts, thumbnails, and metadata are generated by artificial intelligence. VidGen does not guarantee the accuracy, legality, or suitability of any AI-generated content for any particular purpose. You are solely responsible for reviewing all output before publishing, distributing, or monetising it. VidGen accepts no liability for any consequence arising from the use of AI-generated content.

7. Payments & Billing

All point purchases are processed securely through Cashfree Payments. Prices are displayed in Indian Rupees (INR) inclusive of applicable taxes. By completing a purchase you authorise the stated amount to be charged to your payment method. All sales are final — see our Refund Policy for details.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. Video generation depends on third-party AI services (OpenAI, Fish Audio, Modal) and their availability. We are not liable for delays or failures caused by third-party service outages. We reserve the right to modify, suspend, or discontinue the Service at any time.

9. Video Storage & Retention

Generated videos are stored for 5 days by default. You may opt to keep a video permanently using the "Keep forever" option. Videos not kept will be permanently and irrecoverably deleted after the 5-day period. VidGen is not responsible for any content lost due to expiry.

10. Limitation of Liability

VidGen is provided "as is" without warranties of any kind. To the fullest extent permitted by applicable law, VidGen shall not be liable for any indirect, incidental, special, or consequential damages, loss of profits, or loss of data arising from your use of the Service. Our total liability to you shall not exceed the amount you paid for points in the 30 days preceding the claim.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of India.

12. Changes to Terms

We may update these Terms at any time. We will notify users of material changes via the platform. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
